Glossary of Key Terms in our bylaws
- Architectural Review Board (ARB): A committee within the Homeowners Association responsible for reviewing and approving any proposed changes to the exterior of individual properties to maintain community aesthetics and standards.
- Bylaws: A set of rules adopted by an organization (such as a homeowners association) for governing its internal affairs.
- Declaration of Articles of Incorporation: A legal document that establishes the existence of a corporation (in this case, the HOA) and outlines its basic structure and purpose.
- Homeowners Association (HOA): An organization in a planned community, such as a subdivision or condominium complex, that makes and enforces rules for the properties and their residents.
- Common Areas: Areas within a community that are owned and maintained collectively by the Homeowners Association for the benefit of all residents (e.g., walkways, pool area).
- Easement: A legal right to use another person's land for a specific purpose. While not explicitly mentioned, easements are common in planned communities for utilities or access.
- Plat: A map showing the division of a piece of land into lots, streets, and other features. "Delray Villas Plat II" refers to a specific phase or section of the overall Delray West development.
- Rules and Regulations: Specific guidelines established by the HOA that govern the day-to-day activities and appearance of the community and its residents. These are often more detailed and can be updated more frequently than the bylaws.
- Maintenance Payments: Periodic fees paid by homeowners to the HOA to cover the costs of maintaining common areas, providing services, and enforcing regulations.
- Violation: An act that goes against the established rules and regulations of the Homeowners Association, potentially leading to fines or other penalties.
